Terms of Service

Welcome to Escavjarab. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms.

2. Services

We provide the following services:

  • Individual executive coaching and presentation skills training
  • Group corporate training workshops and seminars
  • Public speaking masterclasses and intensive programs
  • Online training resources and materials
  • Consultation and assessment services

3. Acceptance of Terms

By accessing our website, booking our services, or participating in our programs, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

4. Booking and Payment

4.1 Service Booking

  • All bookings must be confirmed in writing via email or signed agreement
  • Prices are subject to change without notice until booking is confirmed
  • Group training dates are subject to availability and minimum participant numbers
  • Individual coaching sessions must be scheduled in advance

4.2 Payment Terms

  • Payment is required in advance for all services unless otherwise agreed
  • Corporate clients may be invoiced with net 30-day payment terms
  • All prices are quoted in Australian Dollars (AUD) and include GST where applicable
  • Payment can be made by bank transfer, credit card, or other agreed methods

4.3 Late Payment

Overdue accounts may be subject to a late payment fee of 1.5% per month or the maximum rate permitted by law, whichever is lower.

5. Cancellation and Refund Policy

5.1 Client Cancellation

  • Individual Coaching: 48 hours notice required for full refund
  • Group Programs: 7 days notice required for full refund
  • Corporate Training: 14 days notice required for full refund
  • Cancellations with less notice may be subject to fees

5.2 Escavjarab Cancellation

We reserve the right to cancel services due to insufficient enrollment, instructor unavailability, or other circumstances beyond our control. In such cases, full refunds will be provided.

5.3 Weather and Circumstances

In-person training may be postponed due to extreme weather or other extraordinary circumstances. Alternative arrangements will be made where possible.

6. Participant Responsibilities

6.1 Attendance and Participation

  • Participants are expected to attend all scheduled sessions
  • Active participation and engagement are required for optimal results
  • Completion certificates require full attendance
  • Missed sessions may be rescheduled subject to availability and fees

6.2 Professional Conduct

  • Respectful behavior toward instructors and other participants is required
  • Disruptive behavior may result in removal from programs without refund
  • Confidentiality of other participants' information must be maintained
  • Mobile phones should be silenced during training sessions

7. Intellectual Property

7.1 Escavjarab Content

  • All training materials, methods, and content are proprietary to Escavjarab
  • Participants may use materials for personal development only
  • Commercial use or redistribution of our content is prohibited
  • Recording of sessions is not permitted without express written consent

7.2 Participant Content

  • Participants retain ownership of their personal presentations and materials
  • Escavjarab may use anonymized case studies for training and marketing purposes
  • Consent will be sought for any identifiable use of participant content

8. Confidentiality

We maintain strict confidentiality regarding:

  • Client business information and strategic plans
  • Individual performance assessments and feedback
  • Corporate training content and customizations
  • Personal development goals and challenges

9. Limitation of Liability

9.1 Service Results

While we strive to provide high-quality training, results depend on individual effort and application. We do not guarantee specific outcomes or career advancement.

9.2 Liability Limitations

  • Our liability is limited to the amount paid for services
  • We are not liable for indirect, consequential, or special damages
  • Participants assume responsibility for applying training content appropriately
  • Professional liability insurance covers our training services

10. Health and Safety

10.1 Physical Activities

Some training activities may involve physical movement or breathing exercises. Participants with health conditions should consult their healthcare provider before participating.

10.2 Venue Safety

  • Participants must follow all venue safety protocols
  • Emergency procedures will be explained at the beginning of sessions
  • Any injuries or incidents must be reported immediately

11. Privacy and Data Protection

Our Privacy Policy, incorporated by reference, governs the collection, use, and protection of your personal information. We comply with Australian Privacy Principles and applicable privacy laws.

12. Testimonials and Marketing

12.1 Use of Testimonials

  • Client testimonials may be used for marketing purposes
  • Permission will be sought before using identifiable testimonials
  • Clients may request removal of their testimonials at any time

12.2 Photography and Video

Training sessions may be photographed or filmed for marketing purposes. Participants will be notified and consent will be obtained for any identifiable use.

13. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, extreme weather, or pandemic restrictions
  • Government regulations or travel restrictions
  • Technology failures or cyber attacks
  • Labor disputes or supplier failures

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Dispute Resolution

15.1 Initial Resolution

We encourage open communication to resolve any concerns. Please contact us immediately if any issues arise.

15.2 Mediation

If direct resolution is not possible, disputes may be referred to mediation before pursuing legal action.

16. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website and take effect immediately for new bookings. Existing contracts will be governed by the Terms in effect at the time of booking.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Escavjarab.
